SEC crypto crackdown: New allegations against Binance and Coinbase. Will BNB survive the crackdown?

Die SEC geht weiter vor allem gegen Binance US vor und wirft Binance Betrug, Vermischung von Kundengeldern und ein Netz von Scheinfirmen vor, um die US-Regulierungsbehörden zu "täuschen".

Die SEC hat geleakte Chats von Binance veröffentlicht, die unter anderem einen zweifelhaften Umgang mit dem firmeninternen BNB-Token belegen sollen (Pump & Dump).

1 (ein) Binance US Kunde soll Zugang zu unregulierten internationalen Binance-Plattform erhalten haben, was die USA streng verbietet.

Weiters wird Binance die Vermischung von Kundengeldern vorgeworfen. Es gab Gerüchte, dass CZ die Assets von Binance US abgezogen hat, entweder um sie vor der SEC zu schützen oder zu veruntreuen. CZ bestereitet das.

Ein weiterer Hauptanklagepunkt, den auch Coinbase betrifft, ist der unregulierte Handel mit Wertpapieren (Securities).

Im Prinzip sieht die SEC fast alle Kryptowährungen außer Bitcoin als Wertpapiere an, was weitreichende regulatorische Folgen hätte, weigerte sich aber im Kongress ihre Auslegung offenzulegen.

Denke, dass das FTX-Disaster und die Verstrickung in die Politik, die SEC jetzt verstärkt auf den Plan gerufen hat, gegen Kryptobörsen vorzugehen.

Vielleicht nutzt es die Biden-Regierung auch, um generell die Krypto-Industrie in den USA zu schwächen.

Andererseits hat Binance sicher auch viel Dreck am Stecken, aber ist das willkürliche Vorgehen der SEC ohne klare gesetzliche Regulierung wirklich im Interesse der Kunden? Man könnte Unreguliertheit auch als Feature sehen.

Was denkt ihr? Wird Binance und Coinbase die Angriffe der SEC überleben? Sollen Kryptowährungen eher wie Wertpapiere oder wie Rohstoffe / Währungen reguliert werden?

The SEC continues to crack down on Binance US in particular, accusing Binance of fraud, commingling of customer funds, and a network of front companies to "deceive" US regulators.

The SEC has published leaked chats from Binance that, among other things, purport to prove dubious handling of the company's internal BNB token (pump & dump).

1 (one) Binance US customer allegedly gained access to unregulated international Binance platform, which the US strictly prohibits.

Furthermore, Binance is accused of commingling customer funds. There were rumors that CZ withdrew assets from Binance US, either to protect them from the SEC or to misappropriate them. CZ denies this.

Another main charge, which also involves Coinbase, is unregulated trading in securities.

In principle, the SEC considers almost all cryptocurrencies except Bitcoin to be securities, which would have far-reaching regulatory consequences, but refused to disclose its interpretation in Congress.

Think the FTX disaster and entanglement in politics, has the SEC now stepping up to crack down on crypto exchanges.

Maybe the Biden administration is also using it to generally weaken the crypto industry in the US.

On the other hand, Binance certainly has a lot of dirt on it, but is the SEC's arbitrary actions without clear legal regulation really in the best interest of customers? One could also see unregulated as a feature.
