O caso Kawara Welch e a parcialidade de julgamento [EN/PT-BR]

Kawara Welch Ramos de Medeiros, 24, was arrested in May 2024 for stalking a doctor from Ituiutaba, Minas Gerais. The case was one of the first stalking crimes to be convicted in Brazil. As it is a relatively new crime in the penal code, it had a lot of repercussions throughout the country with reports on high-rated programs such as Fantástico, on the Globo network, and Domingo Espetacular, on the Record network.

According to the doctor, who filed more than forty police reports against the young woman, she stalked him at work and even on trips, believing she was in a romantic relationship with him. On one occasion, she allegedly made five hundred phone calls and sent one thousand and three hundred messages to his cell phone.

In addition to the calls, Kawara confronted the doctor's wife with arguments and even physical assaults, which resulted in her being arrested in flagrante delicto, when the young woman remained in custody for a week and was eventually released on the condition that she no longer disturb the doctor and his family.

When the conditions were not met, Kawara ended up back in prison, where he remained for almost another year due to his repeated offense when he once again disturbed the doctor. On this occasion, the young woman had become a fugitive after moving to another city and was arrested during a class at the nutrition college in Uberlândia, Minas Gerais.

In interviews with television channels, the doctor claimed that the young woman had created a fantasy that they would have a relationship, which he denies. However, Kawara's defense argues that the doctor sent messages nurturing hope that they would have a relationship and that he could not admit it because of his family.

Regarding the crimes, there is no doubt about the infractions. When questioned about the possible relationship, the doctor denies it and his lawyers and the police argue that even if there was a relationship, it does not justify the crime of stalking and assault committed against the doctor and his family.

However, due to the patient's psychological condition, it would be important to investigate whether there was unethical conduct on the part of the professional in an inappropriate involvement with this patient. If Kawara's defense claims that it has evidence of this relationship, this should also be investigated because it is not appropriate for a doctor to act in this way in the exercise of his profession.

Kawara Welch Ramos de Medeiros, de 24 anos, foi presa em maio de 2024 por perseguir um médico de Ituiutaba, Minas Gerais. O caso foi um dos primeiros crimes de stalking com condenação no Brasil. Por ser um crime relativamente novo no código penal, houve bastante repercussão em todo o país com reportagens em programas de grande audiência como o Fantástico, da rede Globo, e Domingo Espetacular, da rede Record.

Segundo o médico, que registrou mais de quarenta boletins de ocorrência contra a jovem, ela o perseguia no local de trabalho e até mesmo em viagens acreditando ter um relacionamento amoroso com ele. E uma ocasião, ela teria efetuado quinhentas ligações telefônicas e enviado mil e trezentas mensagens para seu telefone celular.

Além das ligações, Kawara confrontava a mulher do médico com discussões a até mesmo agressões físicas, que resultaram em prisão em flagrante, quando a jovem permaneceu durante uma semana presa e acabou sendo solta sob a condição de não perturbar mais o médico e sua família.

Com o descumprimento das condições, Kawara acabou voltando à prisão, onde permaneceu por quase mais um ano devido à reincidência ao voltar a perturbar o médico. Nesta ocasião, a jovem teria se tornado foragida ao se mudar de cidade e foi presa durante uma aula na faculdade de nutrição em Uberlândia, Minas Gerais.

Nas entrevistas aos canais de televisão, o médico alegou que a jovem teria criado uma fantasia de que eles teriam um relacionamento, o que ele nega. No entanto, a defesa de Kawara argumenta que o médico enviava mensagens nutrindo esperança de que teriam um relacionamento e que não poderia assumi-lo por causa da família.

Com relação aos crimes, não há dúvida com relação às infrações. Quando questionados sobre o possível relacionamento, o médico nega e seus advogados e a polícia argumentam que mesmo que houvesse um relacionamento não justifica o crime de stalking e agressão cometidos contra o médico e sua família.

No entanto, devido à condição psicológica da paciente, seria importante investigar se houve conduta anti-ética por parte do profissional em um envolvimento inadequado com esta paciente. Se a defesa de Kawara alega que tem provas deste relacionamento, isto também deveria ser investigado porque não é adequado que um médico haja desta forma no exercício de sua profissão.
